This information is just a simple overview of what seems to be the standard curiosities about labeling hand blended products and selling them. It includes a copy of some of the regulations and how they apply.

There is alot of confusion in the matter of the selling of homemade toiletries and cosmetics.The topic often causes much debate, concern, arguments and general mayhem. Quite often soapmakers branch out from just making soap and create homemade toiletries such as lip balms, lotions, lotion bars, etc. and sometimes they offer them for sale at craft shows, web sites, etc.

You may choose to enjoy creating these products just for family and friend use, but if you decide to take the path of selling these items to the general public, then you must do all you can to obey the law. By not doing so, you cast a shadow over the entire home-business industry and open yourself up to much harm. As you know, while the US Food & Drug Administration (FDA) does not "pre-approve" cosmetics for sale, it does requires that all cosmetics be labeled with, among other things, the ingredients contained in the product. Though there are exceptions, in the great majority of cases, these ingredients must be listed in descending order of predominance in the product.

Though the FDA rarely establishes a name for a specific cosmetic ingredient, if it has done so, that name can be found in the US Code of Federal Regulations at 21 C.F.R. § 701.30, and that name must be used to identify the ingredient on the product label. If the law does not specify the name to be used, the FDA has specified in 21 C.F.R. § 701.3 that the first source to consult after § 701.30 is the Cosmetic, Toiletry & Fragrance Association

(CTFA) Cosmetic Ingredient Dictionary which contains the required International Nomenclature Cosmetic Ingredient (INCI) labeling names.The INCI system was introduced in 1973 by CTFA´s International Nomenclature Committee to support the process of international labeling harmonization. The Dictionary details approximately 12,000 INCI names and the corresponding trade and technical names.

The Food, Drug, and Cosmetic Act (FD&C Act) defines cosmetics by their intended use, as "articles intended to be rubbed, poured, sprinkled, or sprayed on, introduced into, or otherwise applied to the human body...for cleansing, beautifying, promoting attractiveness, or altering the appearance" [FD&C Act, sec. 201(i)]. Among the products included in this definition are skin moisturizers, perfumes, lipsticks, fingernail polishes, eye and facial makeup preparations, shampoos, permanent waves, hair colors, toothpastes, and deodorants, as well as any material intended for use as a component of a cosmetic product.

Cosmetics and Toiletries

Compliance with consumer product safety and information standards is mandatory. This means that all suppliers of goods, including manufacturers, importers, distributors and retailers of cosmetics and toiletries must ensure their products comply with the mandatory requirements. Consumers also have a responsibility to purchase safe products and to use them in a safe manner.

The Information Standards on cosmetics and toiletries also complement the Commonwealth´s Consumer Product Information Standard - ´Cosmetics´.Ingredient Labelling

Cosmetics and toiletries must be labelled in accordance with the Trade Practices (Consumer Product Information Standards) (Cosmetics) Regulations 1991 (the mandatory information standard). Example of labels:

BODY LOTION- Water, Aloe Barbadensis (Aloe) Leaf Juice, Citric Acid, Butyrospermum

parkii (shea butter), Stearic Acid, Cera Alba (beeswax), fragrance, methyl paraben

Cosmetic and toiletry products are substances or preparations intended for placement in contact with any external part of the body, and the mouth and the teeth, with a view to altering the odours of the body, changing its appearance, cleansing it, maintaining it in good condition, perfuming and protecting it.The Information Standard requires products to be labelled with a list of ingredients so consumers may:

* identify ingredients to which they may be allergic or which may cause an adverse reaction; and

* compare various cosmetic products.Cosmetics and Toiletries Covered by the Mandatory Standard:

* creams;

* emulsions;

* face masks;

* gels or oils for the skin,

* lotions;

* tinted bases including liquids, powders or pastes;

* make-up;

* after-bath or hygiene powders;

* toilet or deodorant soaps;

* perfumes;

* toilet waters;

* aftershaves or eau de cologne;

* bath or shower preparations including salts, foams, gels or oils;

* depilatories;

* deodorants;

* hand cleansers;

* hand protection creams or barrier creams;

* hair-care products including hair tints or bleaches;

* products for waving, straightening or fixing hair;

* setting products including lotions, creams or oils;

* conditioning products including lotions, creams or oils;

* hairdressing products including lotions and lacquers;

* brilliantines;

* hair tonics;

* shampoo;

* make-up and products for removing make-up from the face or eyes;

* products intended for application to the lips;

* products for the care of the mouth or teeth;

* products for nail care or make-up;

* shaving creams, foams, lotions or soaps;

* products for tanning without the sun; and

* skin whitening products.

 

In addition to these products, the scope of the standard also includes:

* face paint;

* theatrical make-up;

* baby and general wipes;

* industrial hand cleaners;

* lotions and creams providing sun protection as a secondary function without stating an SPF rating (exceptions

to this are tinted facial make-up other than moisturisers and tinted, unmedicated lip preparations both of which may

state the actual, SPF or similar claim and still be classified as cosmetics);

* cosmetic and toiletry goods sold in duty free stores (if the goods are intended for use in Australia);

* products used in hair and beauty salons; and

* artificial hair adherents.

Cosmetics and Toiletries Not Covered by the Mandatory Standard:

* massage oils;

* toiletries supplied in hotels;

* sun protection lotions/creams with a stated SPF or similar claim;

* skin disinfectants and hygienic hand washes;

* antiseptic mouth washes; and

* toothpaste with therapeutic claims or a product with a fluoride content of more than 1g/kg.Exemptions

The following goods are exempt from the mandatory information standard:

* therapeutic goods within the meaning of the Therapeutic Goods Act 1989;

* cosmetics/toiletries manufactured in Australia for export;

* free samples of cosmetic/toiletry products; and

* testers of a cosmetic/toiletry product.Cosmetic or Therapeutic

The difference between therapeutic goods and cosmetics is not always clear. In general, a therapeutic good can be described as a product which claims to modify a bodily process, or prevent, diagnose, cure or alleviate a disease, ailment or defect.

Following are some examples highlighting differences between cosmetics and therapeutic goods:

Where there is uncertainty as to whether a product is a cosmetic or therapeutic good it is recommended that advice be sought from the Therapeutic Goods Administration (TGA).

Labelling Requirements

The mandatory information standard requires that the product ingredients be listed on the container or the product itself. Where the product is of a size, shape or nature that prevents ingredient labelling the information must be provided by using swing tags, pamphlets, brochures, display panels, charts or similar which are attached to, provided with or prominently displayed near the product.Listing Ingredients

The ingredients are to be listed in descending order calculated by either mass or volume. Alternatively, the ingredients

may be listed in the following way:

* ingredients (except colour additives) in concentrations of 1% or more in descending order by volume or mass; followed by:

* a. ingredients (except for colour additives) in concentrations of less than 1% in any order; and finally

* b. colour additives in any order.The standard does not require the quantity or percentage of each ingredient to be listed.Colour Additives

Where a colour additive may be added to a product, for example to batches for colour matching or used in one or more, but not all, cosmetics in a range the list of ingredients must include a reference to that additive.

The standard requires that any reference to the additive in the list of ingredients must use either:

* the words ´may contain´ (or similar) followed by the name of the additive; or

* the symbol ´+/-´ and the name of the additive.Flavours

Flavours must be included in the ingredients by using the words ´flavour´, ´flavours´, ´aroma´ or ´aromas´ or by listing the individual ingredients in the flavour or flavours.Fragrances

Fragrances must be listed in the ingredients by using the words ´fragrance´, ´fragrances´, ´parfum´ or ´parfums´ or by

listing the ingredients in the fragrance or fragrances.***Incidental Ingredients & Ingredients that Change...i.e. sodium hydroxide (lye)***

Incidental ingredients are not required to be included in the list of ingredients.Incidental ingredients have no technical or functional effect in the cosmetic or toiletry and are present at insignificant levels. See below

Substances that have no technical or functional effect in the cosmetic or toiletry but are present because they are

ingredients of another ingredient are also incidental ingredients. Processing aids are also considered incidental ingredients and include substances:

* added during the production process and then removed before the product is packaged in its final form;

* that have a technical or functional effect in the production process and are converted to a substance already

listed as an ingredient without significantly increasing the concentration of that ingredient; or

* that have a technical or functional effect in the production process but are present in the finished product at

insignificant levels and have no technical or functional effect in the cosmetic.

 

Any ingredient, regardless of concentration, that has a technical or functional effect in the cosmetic must be listed

as an ingredient.Confidentiality Provisions i.e. " Secret Ingredient"The standard provides for the Minister for Consumer Affairs to grant an exemption or trade secret status to an

ingredient for the purposes of this information standard. If trade secret status is granted, the ingredient need

only be identified in the ingredient list as ´other ingredient´.

Is It a Cosmetic, a Drug, or Both? (or Is It Soap?)

The legal difference between a cosmetic and a drug is determined by a product´s intended use. Different laws and

regulations apply to each type of product. Firms sometimes violate the law by marketing a cosmetic with a drug claim, or by marketing a drug as if it were a cosmetic, without adhering to requirements for drugs.How does the law define a cosmetic?

The Food, Drug, and Cosmetic Act (FD&C Act) defines cosmetics by their intended use, as "articles intended to be rubbed, poured, sprinkled, or sprayed on, introduced into, or otherwise applied to the human body...for cleansing, beautifying, promoting attractiveness, or altering the appearance" [FD&C Act, sec. 201(i)].

Some products meet the definitions of both cosmetics and drugs. This may happen when a product has two intended uses. For example, a shampoo is a cosmetic because its intended use is to cleanse the hair. An antidandruff treatment is a drug because its intended use is to treat dandruff. Consequently, an antidandruff shampoo is both a cosmetic and a drug.

Among other cosmetic/drug combinations are toothpastes that contain fluoride, deodorants that are also antiperspirants, and moisturizers and makeup marketed with sun-protection claims. Such products must comply with the requirements for both cosmetics and drugs.What about "cosmeceuticals"?

The FD&C Act does not recognize any such category as "cosmeceuticals." A product can be a drug, a cosmetic, or a combination of both, but the term "cosmeceutical" has no meaning under the law. How is a product´s intended use established?

Intended use may be established in a number of ways. Among them are:

* Claims stated on the product labeling, in advertising, on the Internet, or in other promotional materials. Certain claims may cause a product to be considered a drug, even if the product is marketed as if it were a cosmetic. Such claims establish the product as a drug because the intended use is to treat or prevent disease or otherwise affect the structure or functions of the human body. Some examples are claims that products will restore hair growth, reduce cellulite, treat varicose veins, or revitalize cells.

* Consumer perception, which may be established through the product´s reputation. This means asking why the consumer is buying it and what the consumer expects it to do.

* Ingredients that may cause a product to be considered a drug because they have a well known (to the public and industry) therapeutic use. An example is fluoride in toothpaste.

This principal also holds true for essential oils in fragrance products. A fragrance marketed for promoting

attractiveness is a cosmetic. But a fragrance marketed with certain "aromatherapy" claims, such as assertions that the scent will help the consumer sleep or quit smoking, meets the definition of a drug because of its intended use.How are the laws and regulations different for cosmetics and drugs?

The following information is not a complete treatment of cosmetic or drug laws and regulations. It is intended only to alert you to some important differences between the laws and regulations for cosmetics and drugs in the areas of approval,good manufacturing practice, registration, and labeling. You should direct questions regarding laws and regulations for drugs to CDER.How approval requirements are different

FDA does not have a premarket approval system for cosmetic products or ingredients, with the important exception of color additives. Drugs, however, are subject to FDA approval. Generally, drugs must either receive premarket approval by FDA or conform to final regulations specifying conditions whereby they are generally recognized as safe and effective, and not misbranded.

Currently, certain -- but not all -- over-the-counter (OTC) drugs (that is, non-prescription drugs)

that were marketed before the beginning of the OTC Drug Review (May 11, 1972) may be marketed without specific approval pending publication of final regulations under the ongoing OTC Drug Review. Once a regulation covering a specific class of OTC drugs is final, those drugs must either -

* Be the subject of an approved New Drug Application (NDA) [FD&C Act, sec. 505(a) and (b)], or

* Comply with the appropriate monograph, or rule, for an OTC drug.What do these terms mean?

An NDA is the vehicle through which drug sponsors formally propose that FDA approve a new pharmaceutical for sale and marketing in the U.S. FDA only approves an NDA after determining, for example, that the data are adequate to show the drug´s safety and effectiveness for its proposed use and that its benefits outweigh the risks. The NDA system is also used for new ingredients entering the OTC marketplace for the first time. For example, the newer OTC products (previously available only by prescription) are first approved through the NDA system and their ´switch´ to OTC status is approved via the NDA system.

* FDA has published monographs, or rules, for a number of OTC drug categories. These monographs, which are published in the Federal Register, state requirements for categories of non-prescription drugs, such as what ingredients may be used and for what intended use. Among the many non-prescription drug categories covered by OTC monographs are -

o acne medications

o treatments for dandruff, seborrheic dermatitis, and psoriasis

o sunscreensA note on "new drugs": Despite the word "new," a "new drug" may have been in use for many years. If a product is intended for use as a drug, no matter how ancient or "traditional" its use may be, once the agency has made a final determination on the status of an OTC drug product it must have an approved NDA or comply with the appropriate OTC monograph to be marketed legally in interstate commerce. Certain OTC drugs may remain on the market without NDA approval pending final regulations covering the appropriate class of drugs.

How good manufacturing practice requirements are different

Good manufacturing practice (GMP) is an important factor in assuring that your cosmetic products are neither adulterated nor misbranded. However, no regulations set forth specific GMP requirements for cosmetics. In contrast, the law requires strict adherence to GMP requirements for drugs, and there are regulations specifying minimum current GMP requirements for drugs [Title 21 of the Code of Federal Regulations (CFR), parts 210 and 211]. Failure to follow GMP requirements causes a drug to be adulterated [FD&C Act, sec. 501(a)(2)(B)].How registration requirements are different - Active & Inactive IngredientsFDA maintains the Voluntary Cosmetic Registration Program, or VCRP, for cosmetic establishments

and formulations [21 CFR 710 and 720]. As its name indicates, this program is voluntary. In contrast, it is mandatory for drug firms to register their establishments and list their drug products with FDA [FD&C Act, sec. 510; 21 CFR 207].How labeling requirements are different

A cosmetic product must be labeled according to cosmetic labeling regulations. See the Cosmetic Labeling Manual for guidance on cosmetic labeling. OTC drugs must be labeled according to OTC drug regulations, including the "Drug Facts" labeling, as described in 21 CFR 201.63. Combination OTC drug/cosmetic products must have combination OTC drug/cosmetic labeling. For example, the drug ingredients must be listed alphabetically as "Active Ingredients," followed by cosmetic ingredients, listed in order of predominance as "Inactive Ingredients."And what if it´s "soap"?

Soap is a category that needs special explanation. That´s because the regulatory definition of "soap" is different

from the way in which people commonly use the word. Products that meet the definition of "soap" are exempt from the provisions of the FD&C Act because -- even though Section 201(i)(1) of the act includes "articles...for cleansing" in the definition of a cosmetic -- Section 201(i)(2) excludes soap from the definition of a cosmetic.

How FDA defines "soap"

Not every product marketed as soap meets FDA´s definition of the term. FDA interprets the term "soap" to apply

only when --

* The bulk of the nonvolatile matter in the product consists of an alkali salt of fatty acids and the product´s

detergent properties are due to the alkali-fatty acid compounds, and

* The product is labeled, sold, and represented solely as soap [21 CFR 701.20].

If a cleanser does not meet all of these criteria...

If a product intended to cleanse the human body does not meet all the criteria for soap, as listed above, it is either

a cosmetic or a drug. For example:

If a product --

* consists of detergents or

* primarily of alkali salts of fatty acids and

* is intended not only for cleansing but also for other cosmetic uses, such as beautifying or moisturizing,it is regulated as a cosmetic.

If a product --

* consists of detergents or

* primarily of alkali salts of fatty acids and

* is intended not only for cleansing but also to cure, treat, or prevent disease or to affect the structure or

any function of the human body,

it is regulated as a drug.If a product --

* is intended solely for cleansing the human body and

* has the characteristics consumers generally associate with soap,

* does not consist primarily of alkali salts of fatty acids,

 

it may be identified in labeling as soap, but it is regulated as a cosmetic.

Subpart B -- Package FormSec. 701.12 Name and place of business of manufacturer, packer, or distributor.

(a) The label of a cosmetic in package form shall specify conspicuously the name and place of business of the

manufacturer, packer, or distributor.

(b) The requirement for declaration of the name of the manufacturer, packer, or distributor shall be deemed to be

satisfied in the case of a corporation only by the actual corporate name, which may be preceded or followed by the name of the particular division of the corporation. Abbreviations for "Company," "Incorporated," etc., may be used and "The" may be omitted. In the case of an individual, partnership, or association, the name under which the business is conducted shall be used.

(c) Where the cosmetic is not manufactured by the person whose name appears on the label, the name shall be qualified by a phrase that reveals the connection such person has with such cosmetic; such as, "Manufactured for _______",

"Distributed by ________", or any other wording that expresses the facts.

(d) The statement of the place of business shall include the street address, city, State, and ZIP Code; however,

the street address may be omitted if it is shown in a current city directory or telephone directory. The requirement for inclusion of the ZIP Code shall apply only to consumer commodity labels developed or revised after the effective date of this section. In the case of nonconsumer packages, the ZIP Code shall appear either on the label or the labeling (including the invoice).

(e) If a person manufactures, packs, or distributes a cosmetic at a place other than his principal place of business,

the label may state the principal place of business in lieu of the actual place where such cosmetic was manufactured or packed or is to be distributed, unless such statement would be misleading.

Label Warnings

Cosmetics which may be hazardous to consumers when misused must bear appropriate label warnings and adequate directions for safe use. The statements must be prominent and onspicuous. Some cosmetics must bear label warnings or cautions prescribed by regulation (21 CFR 740). Cosmetics in self-pressurized containers (aerosol products), feminine deodorant sprays and, children´s bubble bath products are examples of products requiring such statements.

Hand-blended cosmetics include lotions, creams, lotion bars, bath salts etc. They require the INCI name for the ingredients, it is the legal way to label the ingredients. Ingredients should always be listed in decending order with the highest % first down to the smallest % last. Soap is not considered a cosmetic, so not regulated by INCI, but it is provided for those of you who wish to use it.

INCI names are determined by the International Cosmetic Ingredient Dictionary published by the Cosmetic, Toiletry, and Fragrance Association (CTFA).

Following is an overview of the carrier oils, essential oils, butters, botanicals and cosmetic ingredients and miscellaneous additives that are used in the formulating and hand- blending of Moose Creek Bath & Body products. Labeling Soaps....to I.N.C.I. or not to I.N.C.I.

It´s not required by the FDA that you label the ingredients on handcrafted soap. Many soapers want to label the ingredients so people know what is in the soap. Common names are often used, but if you want, you can use the I.N.C.I name in parenthesis.

These INCI names assume you are using Sodium Hydroxide for saponification. lf you are using Potassium Hydroxide you would change the first word from "sodium to "potassium. For example: "sodium castorate" would become "´potassium caststorate".
